The youngster had pointed a toy BB gun at the officers before being
chased and gunned down with one officer firing 16 times at him.
New CCTV video, obtained by the New York Daily News, shows a terrified Charles surrendering before being shot multiple times by the pursuing cop.
The teen was shot in the bum, the side and the chest and was later put in a medically included coma for three weeks.
He also underwent surgery while in hospital.
After recovering he pleaded guilty in a Family Court to possessing a fake gun.
In a sworn deposition, he said: “I put up my hands, they was still shooting.”
The teen insists he ran from officers because he was scared.
Charles claims he pointed the toy gun at another boy and then started running when he saw the cops.
He was shot once in the buttocks while running before dropping to knees where he was allegedly shot another two times.
A police investigation into the incident found that the cops involved had acted appropriately and were not disciplined.
Only one of the officers used his weapon and fired every bullet in his ammunition clip.
Charles’ team of lawyers are now pushing for a lawsuit to be put
before a jury to determine whether the cops used excessive force.
A Manhattan Federal Judge will now decide whether the case should be taken to court.
David Shanies, Phil Smallman and Michael Colihan, told the Daily News that the new video disproves the police officers’ claims.
A statement said: “The officer’s claim that this young man repeatedly
took aim at him with an unloaded toy gun not only defies logic, but it
is blatantly contradicted by the video.”
